Can two houses be built on one plot of land

Many landowners in urban outskirts often have the need to construct not just one but several houses on their land. Such requirements can have various reasons, and the key here is to correctly process all the necessary documents for the construction and legalization of these two houses on one plot. To address this issue, one should thoroughly familiarize themselves with the legislation of Ukraine.

Before commencing construction, it is crucial to ensure that the designated purpose of the plot allows for the construction of residential buildings. Specifically, land intended for individual construction is meant for this purpose.

Unfortunately, according to established norms and rules, only one residential building can be constructed on one plot of land. However, the legislation does not prohibit placing residential premises in other structures on the plot, such as a summer kitchen, guesthouse, sauna, security and service personnel building, or a garage. Nevertheless, these buildings are considered auxiliary structures, not separate residential houses.

The legislation governing urban planning activities and the Civil Code of Ukraine stipulate the possibility of constructing only one residential building on one plot of land. Other structures fall under the category of auxiliary and do not have the right to be registered as separate residential houses.

If the landowner intends to legalize another house solely as a residential one, it is necessary to undergo the procedure of dividing the plot into two separate plots. After this, each plot will be assigned an individual cadastral number, and on each plot, it will be possible to construct a separate residential building, provided it does not contradict construction norms and requirements concerning distances to other structures, roads, and utilities.

As an alternative option, if the legal status of the building is not critical, the second house can be registered as a summer kitchen or a guesthouse. This practice does not violate the legislation and does not require undergoing complex procedures.

Resolving issues regarding the construction and legalization of two houses on one plot of land may prove to be a complex and bureaucratic process. If the owner lacks the time or experience in handling such matters, it is advisable to seek consultation from the lawyers of the “Grandliga” law association.
