OnlyFans Income and a Tax Letter in Ukraine: What a Taxpayer Should Do

Income received through international online platforms is no longer an “invisible” area for tax authorities. Content creators, bloggers, freelancers and other individuals who receive payments from foreign companies may face a request from the State Tax Service of Ukraine, a demand to provide explanations, a need to file an annual tax declaration, or even a tax assessment notice with additional tax liabilities.

This issue has become particularly relevant for income received through OnlyFans. Ukrainian court practice in such disputes is already developing. The outcome of a case often depends not only on the fact that income was received, but also on the evidence, the tax authority’s calculations and whether the proper procedure was followed. Professional analysis of Ukrainian court practice shows that OnlyFans-related tax disputes have already formed a separate category of cases.

Why the Ukrainian Tax Authority Is Interested in OnlyFans Income

For the State Tax Service of Ukraine, the key issue is not the use of a specific platform, but the receipt of income from a foreign source. If an individual who is a Ukrainian tax resident receives funds from a foreign company or platform, such amounts may be treated as foreign-source income.

The State Tax Service of Ukraine explains that individuals who are residents of Ukraine must declare income received both in Ukraine and abroad, and foreign income is taxable in Ukraine. This means that the problem usually arises not because of the platform itself, but because the income was not declared, was declared incorrectly, or was calculated by the tax authority on the basis of its own data without proper confirmation of actual bank receipts.

What Taxes May Be Assessed

For an individual who receives foreign income outside a properly structured business activity, the main tax is personal income tax. The standard personal income tax rate in Ukraine is 18%. The State Tax Service also confirms that foreign income is subject to personal income tax at the 18% rate.

The military levy should also be taken into account. For income received up to and including 31 December 2024, the military levy rate was 1.5%. For income accrued or paid from 1 January 2025, the military levy rate is 5%.

It is also important to determine the correct taxable base. If income is received in foreign currency, it must be converted into Ukrainian hryvnia using the official exchange rate of the National Bank of Ukraine on the date the income was accrued or received. An incorrect exchange-rate date may significantly affect the amount of additional tax assessed.

What to Do if You Receive a Letter from the Tax Authority

The first rule is not to ignore the letter. If it is an official request from the tax authority, the taxpayer is generally required to provide the requested information and supporting documents within 15 business days from the day following receipt of the request, provided that the request has been issued properly and no special exception applies.

The second rule is not to rush into filing a declaration without checking the amounts. In practice, taxpayers sometimes try to “close the issue” by quickly filing a declaration, but an error in the income amount, exchange rate or reporting period may make the situation worse.

After receiving a tax letter, it is advisable to:

  • check what exactly the State Tax Service is requesting: explanations, documents, a declaration or information about specific payments;
  • determine the period covered by the request;
  • collect bank statements;
  • obtain payout history from the platform;
  • check fees, currency conversion and the actual amounts credited to the account;
  • compare foreign-currency amounts with the NBU exchange rate on the date the income was received;
  • prepare a legally accurate response.

Deleting the account, changing a bank card or denying obvious bank receipts does not solve the problem. On the contrary, such actions may create additional risks.

Typical Errors by the Tax Authority in OnlyFans-Related Tax Disputes

In disputes involving OnlyFans income, evidence is crucial. The tax authority may incorrectly determine the actual amount of income, the date of receipt, the applicable exchange rate or whether the funds belong to a particular taxpayer.

In one reported court case, the tax authority calculated the taxable base at a significantly higher amount than the sum actually confirmed by bank statements: USD 179,942 compared with USD 43,200. The court also noted that the tax authority used the NBU exchange rate at the end of the year instead of the rate applicable on the date the funds were credited.

Typical errors by the State Tax Service in such cases may include:

  • relying on general information without sufficient primary documents;
  • overstating the amount of income;
  • applying an incorrect exchange rate;
  • incorrectly determining the date when income was received;
  • failing to properly notify the taxpayer about a tax audit;
  • ignoring bank statements or actual transactions;
  • automatically transferring data from letters or information notices without additional verification.

For this reason, the defence strategy in such cases should not be based simply on denying the existence of the platform. It should focus on checking the evidence, calculations and the procedure followed by the tax authority.

When a Tax Assessment Notice or Tax Demand Can Be Challenged

If the State Tax Service issues a tax assessment notice or a tax demand after an audit, the taxpayer is not required to automatically agree with the additional liabilities. At this stage, it is important not to miss the deadlines for protection and to check not only the amount assessed, but also the audit procedure: whether there were proper grounds, whether the taxpayer was duly notified and whether the calculations are supported by documents.

Challenging the tax assessment may be reasonable if:

  • the amount of income was determined incorrectly;
  • the tax authority failed to take actual bank receipts into account;
  • an incorrect NBU exchange rate was used;
  • the taxpayer was not properly notified of the audit;
  • the case file does not contain sufficient evidence;
  • the tax authority violated the procedure;
  • the tax demand or tax assessment notice contains errors.

In such situations, challenging a tax assessment notice may be possible either through an administrative appeal or in court.

Does a Tax Letter Mean a Criminal Case?

A letter from the tax authority or the need to declare foreign income does not, by itself, mean that criminal proceedings have been opened. A tax dispute and the criminal-law assessment of content are separate issues.

At the same time, cases involving adult content should not be treated lightly. If the letter, request or actions of state authorities indicate not only a tax issue but also potential criminal-law risks, a separate legal assessment is needed. It is not advisable to provide explanations on your own if they may later be used against the taxpayer in another proceeding.

How a Tax Lawyer Can Help

In disputes involving foreign income, the assistance of a tax lawyer in Ukraine may be needed before any explanations are submitted to the State Tax Service. An incorrectly prepared response, an incomplete set of documents or a hastily filed declaration may weaken the taxpayer’s position.

A lawyer can assess the legality of the request, check the tax authority’s calculations, prepare a response, build an evidence package and determine whether there are grounds to challenge the additional tax assessment.

A tax lawyer can:

  • analyse the request from the State Tax Service;
  • check whether there are legal grounds to provide a response;
  • prepare explanations and supporting documents;
  • verify the correct calculation of income;
  • compare bank statements with platform payout data;
  • assess the risks of additional personal income tax and military levy;
  • support the taxpayer during a tax audit;
  • prepare an appeal against a tax assessment notice;
  • represent the taxpayer in court.

Conclusion

Income from OnlyFans and other international platforms should not be ignored. If a taxpayer receives a letter from the State Tax Service of Ukraine, it is important not to panic, but also not to leave the situation unanswered. The worst option is to file a declaration with incorrect amounts or provide explanations without first analysing the documents.

The correct approach is to check the status of the letter, collect evidence, analyse actual bank receipts, exchange rates, deadlines and the procedure followed by the tax authority. If the State Tax Service has already issued a tax assessment notice or a tax demand, such decisions may be challenged, especially where the tax authority incorrectly calculated the income or violated the procedure.
