The role of an attorney during interrogation: more than just presence

Being called in for questioning by law enforcement is always a stressful situation, even if the person is not a suspect. In such cases, it would be a good idea to seek legal assistance from a lawyer specializing in criminal law.

At first glance, the role of a criminal lawyer during interrogation may seem minimal: he is simply present at the interrogation and, if necessary, makes a remark to the investigator. However, in reality, a lawyer can do much more to protect his client’s rights.

The lawyer must help the client prepare for the interrogation. To do this you need:

  • try to predict the questions that the investigator may ask.
  • formulate tentative answers to these questions.
  • explain to the client his rights, including the right to refuse to testify on certain issues.
  • provide the client with recommendations on how to correctly answer the investigator’s questions.

Participation of a lawyer during interrogation

During questioning, the lawyer must:

  • monitor the investigator’s compliance with the requirements of criminal procedural legislation.
  • make a remark to the investigator if violations are detected.
  • protect the client’s rights from unlawful pressure from the investigator.

The importance of presence a lawyer

Only the presence of a lawyer during the interrogation can have a significant impact on its outcome. The investigator, understanding that his actions can be appealed by a lawyer, will be more attentive to compliance with the law.
